If the actual cross section were flat for some range of energies the returned cross section would be off by a static number for the entire range of energies. Granted, it would only be by 2% but it would still be wrong.

More importantly though, why is the 2% precision used? Even if one disagrees with the above argument it seems odd to artificially reduce the precision.
